Attorneys in Practice
Barg Coffin attorneys represent clients in all aspects of state and federal water quality law. Our water quality practice includes NPDES and Section 404 fill permits under the Clean Water Act, SPCC plans, Section 401 water quality certifications, and federal and state industrial, construction, and municipal storm water issues. Our practice also encompasses other related areas, including the Safe Drinking Water Act and the Coastal Zone Management Act.
Barg Coffin attorneys also represent clients in proceedings before the California State Water Resources Control Board and the Regional Water Quality Control Boards. This representation includes both assisting in obtaining waste discharge permits under the Porter-Cologne Water Quality Control Act and defending clients in administrative enforcement proceedings. Our attorneys have specific experience in representing and advising clients regarding:
- Obtaining NPDES permits from the U.S. EPA and Regional Boards, including Section 401 certifications
- Obtaining Section 404 individual and nationwide permits from the U.S. Army Corps of Engineers, including preparation of Section 404(b) alternatives analyses and compensatory mitigation requirements
- Representing clients in Section 7 consultations with the U.S. Fish and Wildlife Service and National Marine Fisheries Service
- Clean Water Act and related state law litigation, including administrative, civil and criminal enforcement actions and citizen suits
- Assessing economic benefit models, and developing and advising on supplemental environmental projects
- Addressing all aspects of stormwater permitting including industrial, construction, and municipal separate stormwater system (MS4) permits
